(BUNKER-BUSTERS FOR ISRAEL) HR 7148 (pdf): As previewed in last week’s Round-Up, on 3/18 Rep. Gottheimer (D-NJ) and Mast (R-FL) introduced HR 7148, entitled, the “Bunker Buster Act.” For background/details see last week’s Round-Up. New since last week: Bipartisan bill introduced to authorize supplying Israel with bunker-buster bombs (Jewish News Syndicate); press releases from Gottheimer and Mast; Mast (R-FL-18) 03/22/2022: Tweet – “Whether it’s Ukraine or Israel, the U.S. should empower democracies to defend themselves against tyranny. (NO “PALESTINIAN CONSULATE” IN JERUSALEM) S. Con. Res. 34 (pdf): Introduced 3/23 by Lee (R-UT) and 11 all-Republican cosponsors, “A concurrent resolution to express the sense of Congress in opposition to the establishment of a new Palestinian consulate [sic] or diplomatic mission in Jerusalem.” Notwithstanding the fact that the text talks about (I kid you not) Biden’s plan to “open a Palestinian consulate in Jerusalem” and in its resolved clauses notes that Congress “opposes the establishment of a new Palestinian consulate in Jerusalem,” it is clear that this sloppy/insanely poorly drafted resolution is actually intended as a sense of Congress opposing the establishment of any AMERICAN consulate or diplomatic mission to the Palestinians in Jerusalem (see the difference?). Referred to the Committee on Foreign Relations. Also see Lee’s press release and one-pager about the resolution, which were both apparently the work of the same very bad/drunk drafter, as evidenced by the reference in both to the “Undivided Embassy” in Jerusalem [it seems the drafter knew it was important to get the word “undivided” in there somehow, regardless of whether it makes any sense]. Also see press release and supportive tweet from Hyde-Smith (R-MS), not merely opposing the opening of a US mission to the Palestinians in Jerusalem (which she, too, calls a “Palestinian consulate in Jerusalem”) but going further to state that doing so would “give radical extremist groups [e.g., the two-state-supporting PA] ground to stand on” and would “further embolden non-state actors & undercut our Israeli friends.”
(TARGETING THE UNHRC OVER ISRAEL/PALESTINE) HR 7224 (pdf): Introduced 3/24 by Steube (R-FL) and 4 Republican cosponsors, “To require certain actions relating to the United Nations Human Rights Council, and for other purposes,” aka, “The UN Human Rights Council Reform Act.” Referred to the Committee on Foreign Affairs. The bill seeks to permanently prohibit US contributions (voluntary or assessed) to any UN Commissions of Inquiry that relate to Israel as mandated by the United Nations Human Rights Council; to require the US to use its voice/vote/influence in the UNHRC and the UN General Assembly to defend Israel from scrutiny in the UNHRC (and report to Congress on those efforts); to brief Congress before each session of the UNHRC on the UNHRC’s session agenda and program of work; and to report to Congress annually on all votes related to Israel in the UNHRC, including in the report the amount of US aid given to each of the countries casting each vote. (POSSIBLY ALSO TARGETING PALESTINIANS AT THE UN) HR 7223: Introduced 3/24 by Stuebe (R-FL) and 2 Republican co-sponsors, “To provide for the abolition of certain United Nations groups, and for other purposes.” Referred to the Committee on Foreign Affairs. As of this writing (3:30pm ET on 3/25/22), text of the bill is not online and Steube has not issued a press release or tweeted about it. While we won’t know for sure until text is available, it is possible the bill (like HR 7224) targets Israel/Palestine at the UN, in this case by targeting Palestine-focused UN groups (as has been done repeatedly in the past by members of Congress grandstanding on Israel/Palestine — e.g., bills in 2005/2005, 2007, 2009/2009, 2011, 2013, 2015).
(BLOCKING ANY NEW IRAN DEAL) HR 7159: Introduced 3/18 by Issa (R-CA) and no cosponsors, “To terminate certain waivers of sanctions with respect to Iran issued in connection with the Joint Comprehensive Plan of Action, and for other purposes.” Referred to the Committees on Foreign Affairs, Financial Services, the Judiciary, and Oversight and Reform. Issa press release is here, clarifying that his bill is a companion to Sen. Cruz’s S. 3857, covering in last week’s editon of the Round-Up.
(BILL TOTALLY UNRELATED TO ISRAEL/MIDDLE EAST, BUT….) HR 4521: This week, the Senate took up HR 4521, which in February the House repurposed as the “America COMPETES Act of 2022.” For details of the House version of the bill (which includes Iran- and Israel-related provisions, including a non-germane provision added on the House floor targeting the UN’s Commission of Inquiry investigating Israeli violations of Palestinian rights) see the 2/4/22 edition of the Round-Up. Now in the Senate, Schumer (R-NY) has offered a substitute amendment – currently under consideration – that (among other things) includes a provision banning countries that boycott Israel, or that in any way distinguish between Israel or settlements, from participation in a new technology cooperation program created under Title I of the bill.
LETTERS
(PRESSURE ON JORDAN TO EXTRADITE TAMIMI) Steube et al letter to Blinken: On 3/23, Rep. Steube (R-FL) led a letter, cosigned by 5 Republican colleagues, to SecState Blinken about US efforts to extradite Ahlam Al-Tamimi from Jordan. Tamimi assisted in the carrying out of a suicide bombing in Jerusalem in 2001, for which Israeli Israel sentenced her to multiple life sentences. Israel subsequently released her as part of a deal for the release of an Israeli soldier captured and held in Gaza by Hamas (Gilad Shalit), at which point she settled in Jordan. She remains wanted in the US in connections with the murder and wounding of American citizens in that 2001 terror attack, and the request for her extradition from Jordan is a longstanding point of contention between the US and the Jordanian government. Steube’s letter asks the Biden Administration to answer a list of questions: “1. Is it the State Dept.’s view that the request for Tamimi’s extradition satisfies U.S. law and the requirements of the 1995 treaty? 2. What measures does the State Dept. consider to be available should Jordan persist in failing to comply with the extradition request? 3. Has the State Dept. considered, or will it consider imposing sanctions on Jordan if the lawful U.S. request to extradite Tamimi continues to be disregarded? 4. (DEAR STATE DEPT: DON’T EVEN THINK ABOUT MONITORING ISRAEL FOR HUMAN RIGHTS ABUSES) Diaz Balart letter(?): On 3/24/22, Rep. Diaz Balart (R-FL) tweeted, in response to a sensationalized 3/23/22 report from the Jerusalem Post (US offering $1 million to report on Israeli human rights violations):
“I asked @StateDept to reconsider its grant notice on investigating #Israel for human rights abuses. Rather than looking to criticize our one democratic ally in the region, those resources should be focused on truly oppressive regimes with egregious human rights records.”
Back on 3/10/22 the Washington Free Beacon broke the news of this funding in its own sensationalized account, “How the Biden Administration Is Funding the Effort To Delegitimize Israel.” It re-upped the story with its 3/21/22 report, “Watchdog Wants Biden To Disclose Origins of $1 Million Grant Program To Demonize Israel” [read for yourself the the FOIA request filed by that “watchdog,” bearing the totally-not-a-cynical-grandstanding-effort subject line, “Freedom of Information Act Request for Records Regarding the Biden Administration’s Efforts to Undermine Israel and Advance BDS” and filed along with another FOIA request with an equally totally-not-a-cynical-grandstanding-effort subject line, “Freedom of Information Act Request for Records Regarding the Biden Administration’s Material Support for Palestinian Terrorism”]. (SYRIA SANCTIONS WAIVERS?) Wilson-Tenney-Fallon letter to Blinken: On 3/11/22 (not reported previously in the Round-Up), Reps. Wilson (R-SC), Tenney (R-NY) and Fallon (R-TX) sent a letter to SecState Blinken “concerning reports that the administration will soon be issuing broad waivers under the Syria sanctions regime.” The letter goes on to state that the Biden Administration “has carried out policy toward the Assad regime in Syria that is inconsistent with Congress’ intent in the Caesar Syria Civilian Protection Act of 2019 (Public Law 116-92).” The letter requests – by 5pm on 3/18/22, “copies of all documents and communications relating to discussions to provide a sanctions waiver under the Caesar Act or any other Syria sanctions authority for northern Syria,” and also requests that the Biden Administration answer a list of related questions. 2. Russia/Ukraine <–> Israel/Palestine on the Hill
>>>Aid Repercussions for Israel?
This week Rep. Kinzinger (R-IL-16) caused a minor hullabaloo for a 3/20 Tweet suggesting that Israel’s failure to take a clear position in support of Ukraine (and in line with the US) against Russia might lead to future negative impacts on its U.S. aid. When that Tweet provoked backlash from supporters of Israel, Kinzinger doubled and then tripled down on his argument (see links for/text of all the tweets, below).
Kinzinger’s tweets boil down to an explicit demand for accountability from U.S. allies, in the form of conditions on U.S. military aid, and an explicit assertion that “Israel doesn’t have a special exemption”.
This is not the first time that a member of Congress has supported conditions on aid to Israel or called for cuts to that aid. However, past calls for any kind of oversight of, conditions on, or possible cits to Israel, coming from progressive Democrats concerned with Palestinian rights, have invariably been seized on — by pro-Israel hardliners in the Democratic party, by Republicans writ large, and by many pro-Israel advocacy groups — as a pretext for campaigns attacking the member(s) in question as anti-Israel and/or antisemitic, and for attacking the Democratic party for an alleged anti-Israel/antisemitism problem. In contrast, Kinzinger’s statement (and doubling/tripling down) has been greeted by total silence from members of Congress of both parties and from Israel advocacy groups – not a single tweet or statement (that I could find), no denunciations from pro-Israel advocacy groups.
This muted (to say the least) response to a Republican taking a critical position on aid to Israel is also not without precedent. Indeed, it is reminiscent of what happened in recent months in the context of the drama around appropriating an extra $1 billion for Israel for Iron Dome. In that battle, a handful of statements of opposition/concern about the funding in the House, and a delay of less than 2 days in approving the funding, fueled hundreds of outraged statements by members of Congress (bipartisan) and pro-Israel organizations — continuing for weeks — denouncing those who had expressed concern or opposition to the extra $1 billion for Israel for Iron Dome as enemies of Israel, allies of terrorists, and antisemites. Yet, when that same $1 billion in funding for Israel for Iron Dome hit a wall in the Senate named Rand Paul (R-KY), who single-handedly held up the funding for months, members of Congress and pro-Israel groups largely fell silent.
Observing these two very different kinds of responses from members of Congress and pro-Israel groups with respect to challenges to the sanctity/inviolability/unconditional nature of US aid to Israel, one would be hard-pressed to avoid the conclusion that this issue involves two very different sets of rules of behavior. Under the first rule, there is ZERO TOLERANCE for any suggestion that there should be oversight, accountability, conditionality, or cuts to US aid to Israel, if that suggestion is linked in any way to concerns for Palestinians (and especially if that suggestion comes from progressive Democrats). Under the second rule, suggestions of conditions and even cuts in aid to Israel, or even actions to actively obstruct funding for Israel, are basically non-controversial — so long as the argument/action comes from a Republican and so long as the reasons behind it have nothing to do with the welfare, rights, status, or future of the Palestinians.

Round 2: Later that day Kinzinger tweets a thread doubling down and expanding on and his earlier tweet — “Thread on Israel: so i grabbed the third rail of foreign policy today, as I said Israel needs to pick a side, and that future aid could be at stake. I want to double down on this, let me explain. 2) I deeply support our relationship with Israel. But supporting friends doesn’t mean we look past differences. We have stood with Israel and will continue to do so. But at the moment there is a battle between Good and Evil, between a world based on raw power or… 3) one based one the post WW2 rules. Everyone must pick a side. The outcome of this fight will impact the world my son grows up in, and now is the time to call anyone to the carpet who does not do their utmost. 4) if we don’t want to directly attack Russia, then our leverage is in the world uniting in sanctions and assistance for the people of Ukraine. This includes everyone, and Israel doesn’t have a special exemption. Hopefully they will do the right thing. /end”
Round 3: On 3/22/22, Kinzinger doubled down (tripled down?) again on this same point, with a new tweet: “In this war, there is no middle ground. Israel has to pick a side. Slam me all you want, but this is real and serious. “Israel doesn’t have a special exemption”: “ That tweet was linked to an article in Salon.com — “Israel doesn’t have a special exemption”: Republican slammed for blasting lack of Russia sanctions”

>>>Cardin & BDS in the Spotlight
On 3/20/22, Mehdi Hassan hosted Sen. Cardin (D-MD) on his show, during which Hassan pressed Cardin on the question of the boycotts, divestment and sanctions – and the apparent double standard in Congress that embraces these tactics vis-a-vis Russia/Ukraine but seeks to delegitimize/quash them vis-a-vis Israel/Palestine.
In response, Cardin offered a description of his bill – the Israel Anti-Boycott Act – that bears no resemblance to the actual bill. As described by Cardin, the only thing his bill will do is prevent American companies being forced to boycott Israel by foreign government policies or actions of the UN. In reality, NOT A SINGLE FOREIGN GOVERNMENT, nor the UN, has adopted a policy that would compel or coerce a US company to boycott Israel.
And in reality, what Cardin’s bill seeks to do – and would do under law – is criminalize US companies making their own private decisions to boycott Israel – or settlements – based on their own objections to Israeli policies. And what the law would do is criminalize any US citizen doing anything to support the policy of the EU or UN that calls for (but in no way compels) companies to differentiate between Israel and settlements.
What does it mean that Cardin blatantly misrepresented his bill on national TV this week? One possible answer is that he genuinely doesn’t know what his bill does, notwithstanding repeated go-arounds with the ACLU (for example: here, here, here, here, here, here, here, here).
Another arguably more plausible answer is that Cardin knows exactly what his bill does and deliberately misrepresented it. If that is indeed the case, his decision to characterize his bill in a less-than-factually-accurate manner might suggest that Cardin is today conscious of and sensitive to the fact that — in the context of widespread support for boycotts, divestment, and sanctions as tactics to push back against Russia — one would be hard-pressed to see his bill as anything other than an exercise in double standards and outright hypocrisy when it comes to Americans’ right to protest the policies and actions of foreign countries.
